These terms are an agreement between you and Loopmio @ Origin ("we", "us") about your use of the mobile game Loopmio: Color Sort Puzzle ("Loopmio", "the app") and this website at loopmio.origin.ba. By installing or using Loopmio you accept them. If you do not accept them, do not use the app.
1. Who may use Loopmio
You must be at least 13 years old, or old enough to form a binding contract where you live, whichever is higher, or have permission from a parent or guardian. Loopmio is a general-audience puzzle game and is not directed at children under 13.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of Loopmio on devices you own or control, for your own non-commercial entertainment. That licence lasts as long as these terms do.
We keep everything else. Loopmio, its name, its artwork, its sounds, its level designs and its code stay ours (or our licensors'). Nothing here transfers ownership of any of it to you.
3. What you may not do
- Copy, sell, rent, sublicense or redistribute the app or any part of it.
- Reverse engineer, decompile or disassemble it, except where local law says you may despite this restriction.
- Modify the app or its saved data in order to distribute a changed version, or to misrepresent results to other players.
- Remove or obscure any notice of ownership in the app.
- Use the app in a way that breaks the law, or that breaks the rules of the store you installed it from.
4. Coins, palettes and other in-game items
Coins are earned by playing. Coins and unlocked color palettes are a licensed feature of the app, not property and not currency. They have no value outside the game, cannot be exchanged for money or anything else of value, and cannot be transferred to another person or another device.
Because progress is stored on your device, uninstalling the app, resetting the device or clearing app data will remove your coins and unlocked palettes. We have no copy of them and cannot restore them.
Loopmio has no in-app purchases or subscriptions. Coins and color palettes cannot be bought with real money; the only way to earn them is by playing.
5. Your device and your data
Loopmio stores your progress, coins, unlocked palettes, arcade records and settings on your device. What we do and do not collect is set out in the privacy policy, which forms part of these terms.
Keeping your device and its backups safe is up to you. We are not responsible for save data lost through device failure, loss, theft, reinstallation or a backup that does not include app data.
6. Updates and availability
We may update Loopmio, change how features work, or stop offering the app or any part of it. We may do this without notice, though we will try to give notice for changes that matter. Updates are delivered through the App Store or Google Play under their rules, and your device may install them automatically depending on your settings.
We do not promise the app will be available at all times, on every device, or in every country.
7. The app is provided as it is
To the fullest extent the law allows, Loopmio is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error free, or free of anything harmful.
Some jurisdictions do not allow these exclusions. Where that is the case, this section applies only as far as the law permits, and it does not affect any rights you have as a consumer that cannot be waived.
8. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost progress, lost profits or lost opportunity, arising out of your use of Loopmio.
Where we are liable, our total liability to you for all claims relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or EUR 50.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
9. Ending this agreement
You can end it at any time by deleting the app. We may end it if you break these terms in a serious way. When it ends, your licence to use the app ends with it, and sections 2, 7, 8, 10 and 11 continue to apply.
10. Store terms also apply
Whichever store you installed Loopmio from, that store's own terms apply to your download alongside these terms. If a store's terms conflict with these terms for a copy installed from that store, the store's terms win for that conflict.
If you installed from the App Store
These terms are between you and us, not Apple. Apple is not responsible for Loopmio or its content.
- Apple has no obligation to provide maintenance or support for Loopmio.
- If Loopmio fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
- If a third party claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
The list above reflects Apple's minimum required terms for apps distributed with a developer-supplied end user licence agreement, current as of the date at the top of this page.
If you installed from Google Play
Your download is also governed by the Google Play Terms of Service. Google is not a party to these terms and is not responsible for Loopmio.
11. Governing law
These terms are governed by the laws of Bosnia and Herzegovina, without regard to its conflict of law rules. Disputes will be handled by the courts of Bosnia and Herzegovina.
If you are a consumer in the European Economic Area or the United Kingdom, this does not remove the protection of the mandatory consumer law of the country you live in, and you may bring proceedings in your local courts.
12. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page, and material changes will also be noted in the app's release notes. Continuing to use Loopmio after a change means you accept the updated terms. If you do not accept them, delete the app.
13. The rest
If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce something straight away, that is not a waiver of it. These terms, together with the privacy policy, are the whole agreement between you and us about Loopmio.
